Why dont they bring Saddam to ICJ in The Hague but instead to ISTC in Iraq? Weird?
Why didnt they trialed Saddam at the International Court Of Justice in the Hague but instead to Iraqi Special Tribunal Court which is utterly biased and fill of Shiites and enemy of Saddam.
The reason is simple, U.S does not wanted Saddam to open U.S rotten can which contains full of worms. By bringing Saddam to ITCJ, Saddam will break the secret that U.S indirectly involved in all of Saddam Crimes except the Dujail incident. Is this the justice that Bush keep on braggin about? I say REVENGE.
Answer: Three reasons.
1) Iraq is not under the jurisdiction of the ICJ.
2) The ICJ only rules when a national court won't.
3) The ICJ is a pathetic joke.

Was the ICJ around to enforce Human Rights during the Vietnam War?
The Vietnam war was between the North and the South. Human Rights Violations happened apparently every day. And the ICJ is the International Court of JUstice. I wonder if that was around at the time?? Need this for my reference to my assignment.. On dialup so scrambling thru the net will prolly be longer! Calling out to the adults who were there at the time?
Answer: - The ICJ decides disputes submitted to it by States (countries), not by individuals nor collectives nor parts of States so if you were right and it was a war between the North and the South the parties to this war would have no claim in this Court.
- Seen as a conflict between two waring States, then, neither the USA nor Vietnam ever tried to solve their dispute through this Court.
- The OCJ actually doesn't deal with human rights issues either.

On 14 February 2002 , the International Court of Justice (ICJ) located in the Hague, Netherlands announced its ruling that Foreign Ministers cannot be indicted by the courts of another nation and any arrest warrant issued by the courts or executive officials of one country against a Foreign Minister of another country is, in effect, a violation of international law. And this would be so even if the Foreign Minister in question had been formally indicted on grounds of 'universal jurisdiction' for crimes against humanity.[1]
In April 2000, a Belgian investigating judge issued an international arrest warrant against Mr Abdoulaye Yeordai Ndombasi who was, at that time, Foreign Affairs Minister of the Democratic Republic of Congo (the Congo). The Congo brought a suit against Belgium in the International Court of Justice asking it to declare that Belgium, by issuing the international arrest warrant, violated the legal obligation Belgium owes to the Congo and that Belgium must therefore cancel the arrest warrant.[2] The ICJ, by a vote of thirteen votes to three, held that the issuing of the arrest warrant and its international circulation did violate the Congo's international legal rights. By ten votes to six, the ICJ also ruled that Belgium must 'by means of its own choosing' cancel the arrest warrant.[3]
By the time the case was argued before the ICJ, Mr Yerodai, the person in question was no longer the Foreign Minister of the Congo. On this ground Belgium tried to unsuccessfully argue before the ICJ that the case was 'moot'. During the actual proceedings, the Congo also amended its initial complaint to challenge the assumption of 'universal jurisdiction' by the Belgian judge. Instead, the Congo based its sole argument on the ground that since the arrest warrant was directed -at the time of issue- against an incumbent Foreign Minister who is immune from the judicial process of other courts, Belgian was in breach of international law.
The Court, by a solid majority, accepted the Congo's contention. It held that even in cases of persons accused of war crimes and crimes against humanity incumbent Minister of Foreign Affairs have, under the principles of customary international law, total immunity from another nation's judicial processes. The Court observed that immunity from jurisdiction (by the courts of other nations) does not mean that government officials, including Foreign Ministers enjoy impunity in respect of any crimes they have committed irrespective of their gravity. It observed that 'the immunities enjoyed under international law by an incumbent or former Minister of Foreign Affairs do not represent a bar to prosecution in certain circumstances'.[4]
There were dissenting opinions to what might be considered this 'traditionalist' ruling of the ICJ. Judge Al-Khasawneh (from Jordan)[5] dissented stating that “'the need for effective combating of grave crimes ... represents a higher norm than the rules of immunity' especially in cases of Foreign Ministers whose immunity under international law are not as clear or categorical as 'the immunities of diplomats and Heads of States'.
Judge ad hoc[6] Van den Wyngaert (appointed by Belgium) wrote a long, indeed one could say a bitter dissenting opinion. She stated that 'legal opinion does not support the Court's proposition that Ministers for Foreign Affairs are immune from jurisdiction of other States under customary international law' especially in the light of recent trends of restricting the 'immunity of State officials (including Heads of State) ... where there are allegations of war crimes and crimes against humanity'. She also stated that the ICJ by its ruling might have also afforded 'de facto impunity to an increasing number of government officials'.[7]
By changing some of the actual events in the Milosevic trial that is occurring now in another court room in The Hague[8], a curiosity based on a 'hypothetical' could be extrapolated from this case ofCongo v Belgium. Slobodan Milosevic was indicted for war crimes and crimes against humanity by the United Nations ad hoc International Criminal Tribunal for Former Yugoslavia (ICTFY). The indictments -and later arrest warrants- were issued while Milosevic was President of Yugoslavia. Unlike the facts in Congo v Belgium, the indictments were not issued by an investigating judge and prosecutor in a sovereign State claiming 'universal jurisdiction' but by a prosecutor of an international tribunal relying on the Statute of the ICTFY.

Answer: That depends on your vision of international law. Although both courts are located in the Hague, they operate in very different areas of international law, with different power dimensions, different players, and different goals. The ICJ handles disputes between nation-states, usually over straight-up sovereignty issues like border disputes. So this category of international law is old and protected, but ICJ rulings are often ignored. The ICC handles individual criminal charges against those accused of genocide, war crimes, or crimes against humanity. This is a more narrow and more recent (and more controversial) category of international law. The ICC has hardly concluded one trial so it may be difficult to judge its long-term effectiveness at this point. But it must be said that prosecuting and imprisoning criminals in an international court is certainly a large departure for traditional notions of international law and sovereignty (though it's doubtful that a citizen of any powerful nation would ever stand trial in the ICC).

this is such a difficult case. i dont think you guys will make, even after working on this case for years i still dont know what it is about?!! I think you should ask the ICJ the trail, because well it...well it actually not for "mock" trials... its way to hard for those what does one call them. Mock debats, mock traials and model un trials.

Answer: the international court of justice cannot have Compulsory Jurisdiction meaning that it cannot seek out a case. A case must be brought to the ICJ upon consent. That means that ppl have to report the case to the ICJ before it can have jurisdiction.

Answer: The question is if they would.
Countries have agreed in advance to follow ICJ they have established themselves giving it purpose, which means they should. But, there is no body which enforces the decisions of ICJ and there would be no penalty, specially with the polarization going on and the fact that politically stronger countries are always in the gray area of international law. Countries do have sovereign right to recognize another country... The consequences of not following ICJ would be political and could outline future political conflicts, having been set a bad example... It would be bad for Germany, for example, to give a negative example of not following the decision of revoking the recognition of Kosovo, because not only would ICJ start loosing its purpose, but Germany as carrier of integration process, would really look bad.
... not that Germany has not been looking bad in the eyes of Serbs because of the recognition of Croatia, igniting the Bosnian massacre, creating the total sanctions over Serbia and the bombing of Serbia... Their media manipulation solves their problem even for themselves. Bloody hands are washed by decapitating the losers.
However, these countries have been directly responsible in the creation and escalation of the civil war in Yugoslavia, with their deliberate responsible political moves, breaking UN law, political criminality and manipulating the media, all against Serbia and Serbs, that whatever they do is entirely up to their political calculation since they suffer no consequences on the international scene.
I do not think that Serbia will sue countries for having recognized Kosovo. This political move should have been done in the earliest possible stage when the recognition of Kosovo started, because it is becoming politically pointless as time passes. The ruling party in Serbia is pro Western, and follows the policy of taking orders from there while keeping their voting mass in the illusion of doing something about keeping Kosovo... (If I may be allowed some subjective biasness :) ) Asking Security Council for opinion on the legality of recognition of Kosovo is wasting precious time and is not obligatory for any country. Politics is a game of give and take in the running time, not static black and white...
Serbia didn't sue NATO (btw. USA does not recognize ICJ), while Bosnia sued Serbia and lost the case though in a split decision.

So, yeah... if someone is tried for genocide under the International Court of Justice, can they be executed? Or imprisoned? Who imprisons them? Would it be their home country?

Answer: No death sentence exists in the ICJ, convicted prisoners serve their jail sentence at the Hague in the Netherlands were they are tried.
