How can they take his property?
How can they seize Sanford assets?
The gov. is seizing and selling off properties of the investment guru BUT he has not been convicted of anything (yet) and has proclaimed his innocence . How can this happen?
Answer: I know of a few people who are named Sanford and are in some financial/legal trouble. Knowing which Sanford or location might help me give a better answer.
However, I can give you a quick outline on seizures and forfeitures.
These can take place from a couple of processes and for various reasons:
Criminal Forfeiture Statutes permit the Government to file an action against a property as though the property had committed an offense. This is generally for a property which was used to commit a crime or was purchased with the proceeds of a crime.

In bankruptcy cases a special receiver or trustee may be appointed to manage a property. Sometimes these people recommend that various decisions be implemented for the best management of the property.
Sometimes, there are disputes over true ownership where there are 3rd party claims (such as partners, stock holders or investors) involved, the courts may well authorize an officer to seize a property to protect those interests. Just because you purchased something, does not mean that you truly own it. Others may hold the rights through loans, stocks or other means. Just because it is seized does not mean that it is lost and just because it is sold, does not mean that the proceeds are lost. These things are all a complicated game of who has what at any given time.
In some cases the assets may be deteriorating or endangered in which case an interlocutory sale might be in the best interest of all concerned.
Consider the case of sailors who are not paid for their services. A ship might be seized on their behalf. Seems like a good idea, but then you have cargo which may spoil or otherwise lose value. The ship uses fuel and may have unknown problems. There may be good reasons why this ship might need to be disposed of. This is one example. Livestock would be another. Feed, sanitation, vet bills or other costs might render them a liability in short order if not carefully managed.

None of this is simple -- there are a lot of competing interests involved and the courts struggle to address them all.
No -- the government does not simply do as it pleases -- they lose these cases at times just like everyone else. Frequently, the government is not even a party in civil seizures.
Not everything that is done is as evil as described by a particular party. There are often very good reasons involved. Sometimes, not.
Not perfect, but this is our system.

Answer: Here is what it says:
1. The seller is not in financial difficulty.
2. He will not make any requested repairs...so don't ask for any.
3. If you do not make the offer in writing with a sales contract that is legal in your state, it is not a binding offer.
The rest is just irrelevant ranting.
However, you still have the right to:
1. Get an inspection....he just won't pay for any repairs.
2. Get a survey...he just won't pay for it.
3. Get a home warranty..which you have to get an inspection to receive....and he won't pay for that eitehr.
My advice: The ad screams of arrogance and this will be a difficult transaction for you...to me, it's not worth it....too many houses for sale.

Answer: Your property tax is based upon its assessed value as determined by your local taxing authority AND the millage rate. Not what you paid for the home or what a real estate appraiser assessed the value for the loan. However, you can contest the assessed value quoted on the tax rolls..
It does not good to reduce the assessed value if the taxing authority is going to raise the millage rate, or vice-versa. It's a way to manipulate property values and tax rates to maintain the income for the county's budget. "We're going to lower the tax rate on everyone's property." That's a nice warm fuzzy feeling. But they sometimes don't tell you that they are raising the assessed values (to recover the loss).

if i purchase a property via short sale, and the price is $100,000 and the assesed price is 200,000 does this means that the equity in the property is $100,000?

Answer: Assessment is NOT MARKET PRICE!
You need to determine the real SELLING PRICE!
You could do this by looking at RECENT SALES (no more than six months ago) in the same immediate location. The age, style of home should be similar, as the square footage and bedrooms and baths, etc...
You could hire an appraiser to give you a price, bank appraisals are often coming in very low. You could ask a real estate agent to give you a BPO (buyers price opinion), these opinions are often a 10%-15% too high.
You should also consider the direction and rate of price change in your area. In my opinion there are areas of the country that have further to fall , as well as areas that are dramatically under priced.

Legal gurus please help Estate property?
The story:
3 sibilings who hate each other their parent passed away leaving a very old will appointing sibiling T to the "one in charge" (this will was written before T and her parents had a falling out) anyways since they cannot come to an agreement what should happen to the property T has not been paying taxes on the house and property but forbids any other sibiling from buying it, so of coarse the house goes to the state in an auction for only $2500 (4 acres and a 4 bedroom brick home). Anyone of the sibilings could get the house back if they pay taxes to the state ($1800)but the house would still belong to T.
One of the sibilings is my dad who has tried and wants to buy the property. Their lawyer decided to become a judge and kind of left them in the dust.
My question is: If my dad pays the taxes is there any way for him to be able to have a chance in buying the property??? What legal route should he go? (The property is in another state)
yes it was probated (the will) not sure whose name is on the deed. I am sure it was my grandfathers.
Would we be able to hire an attorney in our state or the state where the house is?
they already had an auction, but we can get the property back if we pay the taxes (that my aunt was supposed to pay) but we still wouldnt be legal owners of the property.

Answer: You need an Atty who can sort out the EXACT status of the property and what can and can not be done by your father.
Has the estate been probated? Whose name/s is on the deed? How does the will state that the estate is to be divided?

Answer: Is the county telling you to fix it? Before you consider giving it up, get some estimates on bringing your home up to code. It may seem like alot of changes/modifications, but an estimate will give you a clear picture of whether it's worth keeping your home or not. Generally it's not all that much to get an addition/modification permitted if the addition was done properly.The market won't stay this way forever, and homes generally increase in value over time, so you may find out that your best bet would be to hang in there, get those estimates, see if the county will give you time (if they're harassing you about it), and see if a lender or your lender might work with getting you the money you may need to make the needed corrections. Otherwise, if the county is not pushing the issue, make the corrections as you can afford to. A house up to code is worth more than a house that isn't. If you have equity in your home and can afford to refi, then it might be a good idea to do so and keep your home. To do a deed in lieu of foreclosure is what I'm thinking you're thinking, where you hand the keys to your lender and walk away from the home, but that is a decision the lender would make, and at this time many lenders are trying to have their clients stay in their homes rather than take them back. Lenders generally don't want the hassle and expense of trying to resell the home. A foreclosure would mess you up big time with your credit. It would take at least 2 years before you could try again to get a home. Hope this helps, good luck :)

Property tax - does it go up if you get upgrades on a new home?

Question...if you buy a townhome for 269.000, but add $10,000 in upgrades (appliances, carpet, painting) during the building and preconstruction....does your property tax go up because you now paid 279,000 for the townhouse (which includes the upgrades)...or will property tax only be and cost on the original price of the house, which is 269,000 ? or will property tax be 2.% percent on the total cost, including upgrades? or are upgrades seperate?
Answer: short answer: yes, probably.
long answer: The tax is based on the tax assessment. The speed at which the new sale price and the upgrades get reflected in a new assessed value varies a great deal from area to area. In my town, they are way behind in updating assessments. By the way, the sale price is a big factor in determining the new assessment, while the value of improvements, especially if done without permit and without the local government's knowledge, may never be reflected in the assessed value.

I heard a TV real estate guru say that a person could buy property and receive cash back at closing. Anyone know how this is done?
Answer: This is *FRAUD*
Not that the law ever stopped most real estate gurus, but this one is a particularly blatant violation.
